The New York Times has filed a lawsuit against Microsoft and OpenAI in the United States District Court for the Southern District of Manhattan. The New York Times alleges that the artificial intelligence models of both companies illegally accessed millions of articles published by the newspaper. The lawsuit does not specify a precise monetary demand, but The New York Times claims that the companies should be held responsible for “billions of dollars in statutory and actual damages” and requests them to destroy the chatbot models and training data that utilize its copyrighted materials. The New York Times accuses the “Browse with Bing” feature of Microsoft’s new Bing (Bing Chat) of using OpenAI’s ChatGPT model to generate “almost verbatim” results from The New York Times’ Wirecutter review website, without actually linking to Wirecutter and removing any financial affiliate links provided by the website’s users for revenue purposes. It is reported that negotiations between the parties took place in April of this year but no agreement was reached. Currently, Microsoft and OpenAI have not responded to the lawsuit.
